Fallout developer Bethesda is suing both Warner Bros. Interactive and developer Behavior over the new Westworld mobile game.
Bethesda alleges that the recently released Westworld mobile game developed by Behaviour “has the same or highly similar game design, art style, animations, features and other gameplay elements” as their popular mobile game Fallout Shelter, which recently released on various consoles.
Bethesda has stated that the Behaviour used “the same copyrighted computer code created for Fallout Shelter in Westworld,” even revealing that a bug in the Westworld game is similar to one that was found in earlier versions of Fallout Shelter, which has now been fixed. Bethesda also alleges that the mobile game copies some of the features and cosmetics of their game.
Fallout Shelter started life as a free-to-play mobile game where players build and manage their own vaults. It has proved to be very popular recently, releasing on various consoles. Similarly, the Westworld game allows players to build and manage their own unique version of the theme park from the hit TV series.
Below is a statement from Bethesda to Variety in which they state the many reasons for filling the lawsuit:
Bethesda Softworks has today filed a complaint in U.S. District Court against Behaviour Interactive and Warner Bros. for copyright infringement, breach of contract, and misappropriation of its intellectual property. The case arises from Behaviour’s development of a ‘Westworld’ mobile game for Warner Bros. Behaviour had previously worked with Bethesda to develop Bethesda’s hit game, ‘Fallout Shelter,’ and under that contract, Bethesda alone owned all resulting intellectual property, including the game’s copyrighted code.
Behaviour illegally used the same copyrighted source code from ‘Fallout Shelter’ to develop ‘Westworld,’ and copied Fallout Shelter’s game design, art, animations, gameplay features, and other elements. As a result of Behaviour and Warner Bros’ unlawful conduct, ‘Westworld’ is a blatant ripoff of ‘Fallout Shelter’ with largely superficial, cosmetic changes.
Bethesda will vigorously protect its legal rights in the valuable intellectual properties it owns, and take legal action whenever those rights are being infringed.
